Online Store Terms and Conditions

Effective from 1.5.2014.

Full terms and conditions for using the Nira online store, ordering, delivery and warranty.

www.nira.fi is a marketplace operated by Nira Pumps Oy (Finland) in which goods are sold by Nira Pumps Oy (business identity code FI 2552547-9).

The following terms and conditions apply to purchases made through the Nira online store and between its users.

Nira.fi sells pumps and accessories to private individuals aged 18 or over (hereafter “consumers”) as well as businesses and organisations (hereafter “business customers”) purchasing from within the EU.

1. All products and prices can be found in our online price list.
2. All products are sold “as described”.
3. Prices include Finnish VAT á 24%.
4. Purchases are made using international credit cards.
5. Delivery is via Itella Logistics’ various services. We only deliver to EU territories.
6. Unless otherwise stated in product information, product warranties are 1 year and cover material and manufacturing defects. Please see section 6 for detailed warranty conditions.
7. Receipts must be kept in case of warranty or reclaim.
8. Products can be returned within 14 days, provided they are unused and can be re-sold.
9. The right to return products applies only to unused products – see details later in this document.

Detailed terms and conditions:

1. Ordering
1.1 When ordering, the customer must always provide:
a) Consumers: name, address, e-mail address, postal address and phone number(s).
b) Business customers: company/organisation name, contact person, e-mail address, postal address, VAT number and phone number.

1.2 By ordering, the customer agrees to the terms and conditions relating to ordering and delivery that are in force at the time of each order. The current terms and conditions can be found on NIra’s website, www.nira.fi.

1.3 Nira.fi’s customer database is confidential. Nira.fi will not pass on information in its customer database to any parties other than those described in these terms and conditions.

1.4 Communication between parties happens via e-mail or telephone. The customer agrees to check their e-mail regularly after placing an order. Nira.fi contact details can be found online at http://www.nira.fi.

1.5 After an order is successfully placed and payment taken, Nira.fi will automatically send an order confirmation e-mail to the customer.

1.6 A binding sales contract steps into force when the customer has placed their order and the payment transaction has been made on the bank/credit provider’s system. The system will automatically send a confirmation e-mail once the customer leaves the bank/credit provider’s page and is redirected to the www.nira.fi site.

1.7 We reserve the right to limit purchases of larger quantities if necessary – for example if supply is low or delayed.

1.8 In the event of supply problems or limited stock, Nira.fi’s liability is limited to cancelling the purchase and returning any monies that may have been paid in advance.

1.9 All products sold by Nira.fi are sold “as described”. Read the product descriptions on our website thoroughly before ordering.

1.10 If the customer does not accept the contents of their delivery, it must be returned within the 14 day return period to Nira Pumps Oy. See section 5.

1.11 In clear cases of product or price errors, Nira.fi reserves the right to cancel the purchase – for example if there is such a clear error in product pricing or details that the customer should have noticed it to be an error.

2. Prices

2.1 The prices in the price list include Finnish VAT (24%). However, it is possible to view and choose VAT 0% prices in the online store. Delivery charges depend on the product in question.

2.2 The shopping basket will always display the delivery costs after the delivery method has been selected.

2.3 The product details for all products can be seen on our website. If an item is returned by the customer due to an error in product details, the customer will not be charged for returning the item. Such a return must be made within a reasonable time after receiving the item, as soon as the error is noticed or reasonably should have been noticed. The customer is expected to notice any such error within a reasonable amount of time.

2.4 In clear cases of price errors, Nira.fi reserves the right to cancel the purchase – for example if there is such a clear error in product pricing that the customer should have noticed it to be an error. .

3. Delivery

3.1 Nira.fi will normally dispatch products within 2-3 working days. In addition to this, normal delivery times within the EU apply (typically around 1 week from dispatch).

3.2 A consumer has the right to cancel their order at any stage, even after the order has been handled for dispatch. Whenever possible, order cancellations should be made via e-mail to the address provided in the order confirmation.

3.3 During delivery from Nira Pumps Oy to the customer, Nira.fi is liable for any loss or damage in transit. During delivery from the customer to Nira.fi, the customer or their transport company is liable for loss or damage in transit. When dealing directly with consumers, Nira.fi is liable for damage to goods in all cases.

4. Payment methods

4.1 Payment for purchases in the online store must be paid in advance. Nira.fi uses the Finnish Paytrail service, which allows the use of a number of payment methods. The Paytrail transaction provider will pass on the payment to Nira Pumps Oy. Payment is possible with most commonly used credit cards.

4.2 Payment using Visa, Visa Electron or MasterCard cards
If you wish to pay using Visa, Visa Electron or MasterCard, Nira Pumps Oy acts only as the marketer of the products and services and the dispatcher of ordered goods to the buyer.
Paytrail Oyj will handle any reclamations.

In payments made using Visa, Visa Electron or MasterCard, Paytrail Oyj acts as the seller of the goods, and the transaction takes place between the customer and Paytrail Oyj. The seller is responsible for all matters relating to the transaction. Paytrail Oyj is also the receiver of the payment.

5. Right to return products

5.1 We offer a 14 day refund or exchange period. This time is counted from when the package is delivered to the customer, including weekends and holidays, not including the delivery date.

5.2 Returns are only accepted for products that are unused and re-saleable. During the 14 day period consumers have the right to acquaint themselves with the product and try it in the same way they would be able to try it in a retail store environment. Consumers may also open the packaging in order to inspect and try the product without affecting their right to return the item or cancel the purchase. However, they may not take the product into use.

5.3 Returning the item is free of charge for consumers. The return address is Nira Pumps Oy, Putajantie 42 (P.O. Box 54), 38201 Sastamala, Finland. We will refund the costs of returning the item upon receiving proof of payment, such as a receipt or invoice from the delivery company.

5.4 The date on which the delivery company has delivered the package will be regarded as the date of purchase/collection.

5.5 If, at our discretion, we accept a product that is non-saleable, incomplete or past its 14 day return period, we will charge a minimum of 25% of the product price to cover our costs.

5.6 Returned products must always be:
a) In their original packaging, properly packed, without unnecessary markings;
b) Accompanied by a copy of the receipt/delivery note;
c) Accompanied by a written description of any fault or defect in the product;
d) Returned within 14 days of the date of purchase.

5.7 When sending us anything, remember to pack the product well. By using the original packaging and inner packaging, you ensure that the product will arrive intact and undamaged. If an item returned by a consumer is damaged by the transport company, the seller (Nira.fi) will accept liability.

6. Limited International Warranty

The warranty period is determined in the agreement documents. Unless otherwise agreed, the warranty period for manufacturing and material defects is 1 year, hand pump models NIRA 1, NIRA 67 and NIRA 3B which carry a warranty of 3 years.

6.1 Warranty Conditions

The warranty is only valid if the warranty demand is presented together with the original invoice or sales slip or (order) confirmation, and the serial number on the product has not been defaced.

NIRA’s obligations are limited to the repair or, at its discretion, replacement of the product or the defective part. Defective parts shall be replaced with new or equivalent “as new” parts. If necessary, the entire product shall be exchanged with an identical or functionally identical product. The value of the warranty service is always limited to the value of the defective product. The defective parts removed from a product as part of a warranty case shall become the property of NIRA and shall be retained for by the End Customer for NIRA, if necessary. If these parts cannot be returned to NIRA upon request, NIRA is entitled to charge for a corresponding amount. When genuine NIRA parts are installed in a NIRA product under warranty, only the remaining warranty period of the repaired device applies.

Warranty repairs must be carried out by NIRA or authorised NIRA Dealers. No re-imbursement will be made for repairs carried out by a non-NIRA representative, and any such repair work or damage to the products caused by such repair work will not be covered by this warranty.

This product is not considered to be defective in materials nor workmanship if it requires adaptation in order to conform to other local or national technical or safety standards.

This warranty covers none of the following:

a) Periodic checks, maintenance and repair or replacement of parts due to normal wear and tear

b) Costs relating to transport, removal or installation of the product;

c) Misuse, including the failure to use this product for its normal purposes or incorrect installation;

d) Damage caused by lightning, water, fire, acts of God, natural catastrophes, war, public disturbances or any other cause beyond the control of NIRA;

e) Spillage of chemicals or liquids, or use of any other hazardous or non-instructed substances, which may affect the product;

f) Minor defects or deviations from the product specifications which are immaterial, negligible or trivial as regards to the value or the functioning of the product

6.2 Proceeding in a Warranty Case

The following information is an explanation of what you must do in the case of a warranty claim. First, please contact your NIRA dealer and describe the problem (possibly with photographs or videos) and inform NIRA of the product type and serial number. NIRA’s technicians will help to diagnose defects and malfunctions, and are often capable of eliminating the malfunction over the phone.

In the event that warranty service is required, you should return the product to the dealer from whom it was purchased, or directly to NIRA’s factory in Finland. In this case, the customer is responsible for the dispatch and insurance of the product, and the transport and insurance costs shall be borne by the customer. NIRA shall assume the costs for the materials / spare parts and the labour costs as required, as well as the standard return transportation to the sender. The guarantee will become void if:

  1. A NIRA product has been used in unspecified conditions or if the product is allowed to come into direct contact with chemicals or agents other than those specified in the manual;

  2. A NIRA product is equipped or used with parts that have not been approved by NIRA for the product in question;

  3. Someone other than a person authorised by NIRA has serviced/repaired or otherwise modified the device and these measures have caused a fault in the product;

  4. Regular maintenance has not been performed.
